Stearns, Conrad and Schmidt, Consulting Engineers, Inc. dba SCS Engineers (“SCS”) does not accept unsolicited resumes from recruiters or agencies. To protect the interests of all parties, SCS will not accept unsolicited resumes from any source other than directly from a candidate. Any staffing/employment agency, person or entity that submits an unsolicited resume does so with the understanding that the applicant’s resume will become the property of SCS. SCS will have the right to hire that applicant at its discretion and without any fee owed to the submitting staffing/employment agency, person or entity.
SCS will consider any candidate for whom any staffing/employment agency has submitted an unsolicited resume to have been referred to by the staffing/employment agency free of any charges or fees.
Staffing/employment agencies are hereby specifically directed NOT to contact SCS employees directly in an attempt to present candidates – SCS’s recruiting team or other authorized SCS personnel must present ALL candidates to hiring managers.
Further, any staffing/employment agency must obtain advance written approval from SCS’s recruiting function to submit resumes, and then only in conjunction with a valid fully-executed contract for service and in response to a specific job opening. SCS will not pay a fee to any staffing/employment agency that does not have such agreement in place. Staffing/employment agencies who have fee agreements with SCS must submit applicants to the designated SCS recruiter or hiring manager to be eligible for placement fees.
Staffing/employment agency agreements will only be valid if in writing and signed by an officer of SCS or his or her designee. No other SCS employee is authorized to bind SCS to any agreement regarding the placement of candidates by staffing/employment agencies.
SCS hereby specifically rejects, and denies any liability under, any agreement purporting to be accepted based on negative consent, negotiation with a candidate, performance, or any means other than the signature of an SCS officer.
